Our team helps coordinate the appropriate process based on your document, the applicable U.S. state requirements, and the country where the Power of Attorney will be used.
From notarization and document preparation to apostille and consular legalization, we help simplify the process and identify the requirements that apply to your situation.
What Is a Power of Attorney Apostille?
A Power of Attorney apostille is an authentication certificate used to verify the origin of an eligible public document or the signature and official capacity associated with its certification for use in another country that recognizes the Hague Apostille Convention.
A Power of Attorney is a legal document that authorizes another person, known as an agent or attorney-in-fact, to act on behalf of the person granting that authority, known as the principal.
Depending on the document and the destination country, the Power of Attorney may need to be notarized before it can be submitted for an apostille or another form of authentication.
An apostille does not independently verify the legal validity or enforceability of the powers granted in the document. The receiving authority determines whether the Power of Attorney meets its legal and administrative requirements.
What Types of Power of Attorney Can Be Authenticated?
Express Apostille Global assists with authentication requests for different types of Power of Attorney documents, subject to the applicable requirements.
- Real Estate Power of Attorney: Authorizing a representative to buy, sell, manage, or transfer property abroad.
- Banking Power of Attorney: Granting authority to handle specified banking or financial matters.
- Business Power of Attorney: Authorizing a representative to act on behalf of a business in approved transactions.
- General Power of Attorney: Granting broader authority to an agent, subject to the terms of the document and applicable law.
- Special or Limited Power of Attorney: Authorizing a representative to perform specific actions or transactions.
- Inheritance and Estate Power of Attorney: Authorizing assistance with inheritance, estate administration, or related legal matters.
- Immigration and Administrative Documents: Power of Attorney documents requested for certain official procedures abroad.
The receiving institution may require specific wording, additional supporting documents, or a particular notarization procedure. We recommend confirming these requirements before signing your document.
Power of Attorney Notarization Services
A Power of Attorney often requires notarization before it can be authenticated for international use.
At Express Apostille Global, we help arrange the appropriate notarization process based on your document and circumstances.
Remote Online Notarization (RON)
Remote Online Notarization allows eligible signers to complete a notarization session online using an approved digital platform, subject to the applicable state’s laws and the requirements of the receiving authority.
Depending on eligibility and service availability, the process may include:
- Scheduling an online notarization appointment.
- Identity verification and required document review.
- Electronic signing during the online session.
- Witness coordination when required and available.
- Completion of the applicable notarial certificate.
Remote Online Notarization is not accepted for every type of Power of Attorney or in every jurisdiction. Certain foreign authorities may require traditional notarization, original wet-ink signatures, specific witnesses, or additional formalities.
Power of Attorney Documents in Different Languages
Power of Attorney documents may be prepared in English or another language, depending on the requirements of the receiving authority.
At Express Apostille Global, we can help coordinate document authentication and professional translation services where available.
Before signing a Power of Attorney written in a language other than English, ensure that you fully understand its contents and that the notary can complete the required notarization under the applicable rules.
If the destination country requires a certified or sworn translation, the translation may need to be completed by a qualified translator and may require separate notarization or authentication.
Depending on the receiving authority’s requirements, the original-language document and its translation may need to be submitted together or authenticated separately.
Important: Translation, notarization, and apostille are distinct procedures. Completing one does not automatically satisfy the requirements for the others.
How to Apostille a Power of Attorney
Our process is designed to help you identify the correct requirements before your document is submitted.
Step 1: Prepare Your Power of Attorney
Provide your completed Power of Attorney document, including any instructions or forms supplied by the receiving institution. If notarization is still required, do not sign the document until you have confirmed the signing procedure.
Step 2: Review the Requirements
Tell us the country where the Power of Attorney will be used and whether the receiving authority has specified any requirements for notarization, witnesses, translations, or authentication.
Step 3: Complete Notarization
If required, arrange an eligible remote online, traditional, or mobile notarization service. The appropriate method depends on the document, applicable law, and receiving authority.
Step 4: Obtain the Apostille or Required Authentication
Once the document has been properly notarized or certified, it can be submitted to the appropriate authority for an apostille or another applicable authentication procedure.
Step 5: Arrange Delivery
After processing is complete, your document can be returned using the available delivery arrangements selected for your order. Processing times vary depending on the notarization method, the competent authority, and any additional legalization requirements.
To get started
Upload your completed but unsigned document if notarization is still required, and provide the destination country and any instructions received from the organization requesting the Power of Attorney.
